    Terms of Service

    1. Acceptance

    By using Driveway Host you agree to these Terms. If you disagree, do not use the platform. We may update Terms at any time; continued use constitutes acceptance.

    2. Description of Service

    Driveway Host is operated by Driveway Host LLC, a California limited liability company. Driveway Host is an online marketplace connecting property owners (“Hosts”) who rent parking spaces and driveways with drivers (“Guests”). Driveway Host is not a parking operator. We do not own, manage, or control any listed space and are not party to any agreement between Hosts and Guests. We are not responsible for the condition, availability, or legality of any listed space.

    3. Eligibility & Accounts

    You must be at least 18 years old to use the Platform. By creating an account you represent that all information you provide is accurate and that you have legal authority to agree to these Terms. You are responsible for all activity under your account. Notify us immediately at drivewayhost@pm.me if you suspect unauthorized access.

    4. Host Obligations

    As a Host you represent and warrant that: (a) you have the legal right to rent your space as owner or with written permission; (b) your listing accurately describes the space, dimensions, access instructions, and restrictions; (c) you will keep your calendar current and honor confirmed bookings; (d) your space complies with all applicable laws, zoning ordinances, and community rules; and (e) you will not discriminate against Guests on any protected basis. Hosts are solely responsible for reporting and paying all taxes on rental income.

    5. Guest Obligations

    As a Guest you agree to: (a) use the space only for the purpose and duration in your booking; (b) comply with all Host rules and applicable laws; (c) not damage the Host’s property or surrounding area; (d) leave the space as you found it; (e) not use the space for any illegal activity; and (f) maintain appropriate vehicle insurance at all times.

    6. Booking & Payment

    All payments are processed by Stripe, Inc. By completing a booking you authorize us to charge your payment method for the total shown at checkout, including the Host’s rate and the Driveway Host service fee. Payment is collected at the time of booking. Hosts receive payouts after each completed stay, minus the applicable host service fee. All amounts are in U.S. dollars.

    7. Cancellations & Refunds

    Guest cancellations: Cancellations made more than 48 hours before the reservation start time receive a full refund minus the service fee. Cancellations within 48 hours of the start time are non-refundable. No-shows are non-refundable.

    Host cancellations: If a Host cancels a confirmed reservation the Guest receives a full refund including the service fee. Hosts who repeatedly cancel may be suspended.

    Disputes: If a space is materially different from its listing, contact us within 24 hours of discovering the issue. We will investigate and, at our sole discretion, may issue a full or partial refund.

    8. Platform Fees

    Driveway Host charges guests a service fee of approximately 10–15% of the booking subtotal and a host service fee on each payout. Applicable fees are always displayed transparently before you confirm. Fees are subject to change with advance notice.

    9. Damage & Liability

    Driveway Host is not liable for damage to vehicles, property, or persons arising from use of a listed space. Hosts and Guests are responsible for resolving disputes with each other directly. You are responsible for your own vehicle, belongings, and actions on any listed property.

    10. Prohibited Uses

    You may not: post false or misleading listings; use spaces for illegal activities; harass other users; attempt to circumvent payments outside the platform; scrape or copy platform data; or use the platform if you have been suspended or terminated.

    11. Intellectual Property

    All platform content, including text, graphics, logos, and code, is owned by Driveway Host or its licensors. You grant us a non-exclusive license to display content you submit. You may not reproduce or distribute platform content without our written permission.

    12. Disclaimer of Warranties

    THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THE ACCURACY OF ANY LISTING. YOUR USE IS AT YOUR SOLE RISK.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVEWAY HOST’S LIABILITY IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

    14. Indemnification

    You agree to indemnify and hold harmless Driveway Host and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the platform, your listings or bookings, or your violation of these Terms.

    15. Dispute Resolution & Arbitration

    Disputes shall be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, seated in Illinois. You waive the right to participate in a class action. To opt out of arbitration, email drivewayhost@pm.me within 30 days of first accepting these Terms.

    16. Governing Law

    These Terms are governed by the laws of the State of Illinois without regard to conflict-of-law principles.

    17. Termination

    We may suspend or terminate your account at any time for violation of these Terms. Sections 11–15 survive any termination.

    Driveway Host is operated by Driveway Host LLC, a California limited liability company ("Driveway Host", "we", "us"). This policy describes how we collect, use, and protect your information.

    1. Information We Collect

    You provide: name, email, phone, payment information, vehicle details, listing details, messages, and profile content.

    Automatically collected: IP address, browser and device type, pages visited, referral source, and usage timestamps via cookies and log files.

    From third parties: identity verification data, fraud-prevention signals from Stripe, and location data from Mapbox.

    2. How We Use Information

    We use your information to: operate and improve the platform; process payments and host payouts; send booking confirmations and service updates; detect and prevent fraud; comply with legal obligations; and, with your consent, send marketing communications you may unsubscribe from at any time.

    3. Information Sharing

    We share your information with: (a) other users as necessary to complete bookings (e.g., sharing contact details after booking confirmation); (b) service providers including Stripe (payments), Supabase (database and authentication), and Mapbox (maps); (c) law enforcement or regulatory bodies when required by law; and (d) acquirers in a merger or business transfer. We do not sell your personal information.

    4. Cookies & Tracking

    We use cookies and similar technologies to keep you signed in, remember your preferences, and analyze usage patterns. You can disable cookies in your browser settings, though some platform features may not function properly without them.

    5. Data Security

    We implement industry-standard security measures including TLS encryption in transit, secure credential storage via Supabase, and Stripe’s PCI-DSS-compliant payment infrastructure. No method of transmission is 100% secure and we cannot guarantee absolute security.

    6. Data Retention

    We retain your account data while your account is active and for up to 5 years after closure for legal and financial compliance purposes. Booking records may be retained longer where required by applicable law.

    7. Third-Party Services

    Our platform integrates Stripe (privacy policy), Supabase (privacy policy), and Mapbox (privacy policy). Their own privacy practices govern data they independently collect.

    8. Children’s Privacy

    The platform is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us immediately and we will delete it.

    9. California Privacy Rights (CCPA)

    California residents may request to know what personal information we hold about you, request deletion of that information, and opt out of any sale of personal data (we do not sell personal data). To exercise your rights, email drivewayhost@pm.me. We will not discriminate against you for exercising these rights.

    How do I book a parking space?
    Browse available spaces on the Browse page. Click a listing to view details, select your dates and times, then click "Book Now." You'll be prompted to sign in (or create a free account) and then pay securely via Stripe. You'll receive a booking confirmation by email with the host's address and access instructions.
    What is Instant Book?
    Instant Book listings are confirmed immediately — no need to wait for host approval. These spaces display a ⚡ bolt icon in search results. You can filter for Instant Book spaces using the filter chips on the Browse page.
    Can I book a space for multiple nights?
    Yes. Most listings support multi-night bookings. Use the date picker in the booking form to select your check-in and check-out dates. Many hosts also offer discounted monthly rates, which you'll see listed on their space's detail page.
    How do I access the space after booking?
    After booking, you'll receive the host's exact address, any gate codes or access instructions, and the host's contact info through our in-app messaging system. If you have trouble finding or accessing the space, message the host directly through your dashboard.
    What happens if the space isn't available when I arrive?
    First, contact the host through your dashboard. If the issue can't be resolved, contact our 24/7 support team. In verified cases where the space is unusable, we'll issue a full refund and help you find an alternative nearby.

    How do I list my driveway?
    Click "List Your Space" in the navigation. Sign in or create an account, then fill out the listing form with your space details — size, amenities, availability, and pricing. Once submitted, your listing goes into a quick review process and typically goes live within a few hours.
    How much should I charge?
    Rates depend on your location, amenities, and proximity to events. Standard driveways average $25–$55/night. Spaces near stadiums or in cities can command $60–$150+ on event nights. We recommend starting at the lower end of your market and adjusting based on demand. Use the Browse page to see what similar spaces near you charge.
    When do I get paid?
    Hosts receive payouts via Stripe 24 hours after the guest's check-in time. This delay protects against last-minute cancellations. Payouts go directly to your connected bank account and typically clear within 1–3 business days depending on your bank.
    What is the host service fee?
    Driveway Host charges a 10% service fee on each booking, deducted from your payout. For example, if your space is listed at $40/night and a guest books for 2 nights ($80 total), you receive $72. Guests also pay a small booking fee on their end to help cover platform costs.
    Can I decline a booking request?
    Yes. If your listing is not set to Instant Book, you can review and decline booking requests within 24 hours. For Instant Book listings, guests can book immediately, but you can still cancel a booking with appropriate notice if there's a conflict. Frequent cancellations may affect your host standing.
    Payments
    What payment methods are accepted?
    We accept all major credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay, and Google Pay through our Stripe integration. Payment information is encrypted and never stored on our servers.
    Is my payment information secure?
    Yes. All payments are processed by Stripe, a PCI-DSS Level 1 certified payment processor. Driveway Host never sees or stores your full card number — only the last 4 digits for display purposes. Stripe's encryption and fraud detection protect every transaction.
    When is my card charged?
    Your card is charged immediately when you complete a booking. For Instant Book listings, the full amount is charged at the time of booking. For request-to-book listings, a hold is placed on your card when you submit the request, and charged only if the host accepts.
    Cancellations & Refunds
    What is the cancellation policy?
    The default policy is: Full refund if cancelled 48+ hours before check-in. 50% refund if cancelled 24–48 hours before check-in. No refund for cancellations within 24 hours of check-in. Individual hosts may set stricter or more flexible policies — check the listing's detail page before booking.
    How do I cancel a booking?
    Go to your Dashboard → Bookings, find the booking you want to cancel, and click "Cancel." The system will show your refund amount based on the applicable policy. Refunds typically appear on your statement within 5–10 business days.
    What if the host cancels on me?
    If a host cancels your confirmed booking, you'll receive a full refund automatically. We'll also apply a platform credit toward your next booking as compensation. Hosts who cancel confirmed bookings receive a warning and may be suspended from the platform after repeated violations.
    Safety & Trust
    Are hosts and guests verified?
    Yes. All users must verify their email address. Guests must also verify their identity with a government-issued ID before their first booking. Hosts with Verified badges have completed additional identity and property verification through our trust & safety process.
    What does Host Protection cover?
    Our Host Protection program covers property damage caused by guests during a booking, up to $10,000 per incident. To file a claim, document the damage with photos, submit a report through your dashboard within 48 hours of check-out, and our team will review it within 3–5 business days.
    What if I have a safety emergency during a booking?
    Always call 911 first for any immediate safety emergency. Then contact our 24/7 trust & safety support team via email at drivewayhost@pm.me. For non-emergency disputes or concerns, use the Dispute feature in your dashboard.
    Account
    How do I create an account?
    Click "Sign Up" in the top navigation. Enter your email and a password, choose whether you're joining as a guest or host (you can do both), and verify your email address. Your account is ready immediately.
    Can I be both a host and a guest?
    Absolutely. One account handles both. Your dashboard has separate sections for your bookings (as a guest) and your listings and host bookings. Many of our most active users both rent out their own driveway and book spaces in other cities when they travel.
    How do I delete my account?
    To request account deletion, email us at drivewayhost@pm.me with the subject line "Account Deletion Request." Please note that we're required to retain certain transaction records for legal and tax purposes for up to 7 years, but your personal profile will be removed.

    Driveway Host works because hosts and guests treat each other — and the neighborhood — with respect. These aren't suggestions. They're requirements for every booking.

    Standards for Every Booking

    Violations of these standards may result in booking cancellation, account suspension, and forfeiture of payout or refund.

    Host Responsibilities

    You're inviting a guest onto your property and into your neighborhood. These standards apply to every listing, every booking.

    Provide a clean, safe space. The driveway must be free of debris, oil spills, trip hazards, and unmarked obstacles. What your listing shows is what the guest arrives to find.
    Ensure adequate lighting for nighttime stays. A motion light or driveway light must be operational for any booking that includes overnight hours.
    Respond within 2 hours of a booking request. Instant Book hosts are exempt, but all other hosts must confirm or decline promptly.
    Respect quiet hours: 10 PM – 7 AM. Do not contact guests, operate noisy equipment, or create disturbances during these hours.
    Be a good neighbor. If neighbors have raised concerns about your hosting activity, address them proactively. Your neighbors' comfort protects your listing.
    Provide the Window Placard to overnight guests. Each booking generates a printable Window Placard. Ensure guests know to display it. Physical placards and window shades are available in the DH Store.
    Honor confirmed bookings. Same-day cancellations without emergency documentation result in host penalties and a full guest refund.
    Keep the space accurately listed. If your space changes (construction, new obstacle, temporarily unavailable), update or pause your listing immediately — don't wait for a guest to arrive and find a problem.
    Guest Responsibilities

    You're a visitor on someone's private property in their neighborhood. These standards are the minimum expected of every Driveway Host guest.

    Display the Window Placard. The DH Window Placard or Window Shade must be visible in your windshield for any overnight or extended stay. It identifies you as a verified, booked guest — not an abandoned or trespassing vehicle.
    Arrive and leave within your booked window. Do not arrive early or overstay without explicit host approval. Early arrivals block the space for the previous guest or host use.
    Leave the space cleaner than you found it. Remove all trash, food containers, wrappers, cigarette butts, and debris. Do not leave anything on the host's property.
    Observe quiet hours: 10 PM – 7 AM. No music audible outside the vehicle, no engine idling, no loud conversations, no doors slamming repeatedly.
    Park only in your designated space. Do not overflow onto the lawn, neighboring property, sidewalk, or street. Stay within the boundaries shown in the listing photos.
    Do not use host utilities without permission. Electricity, water, trash bins, and any other amenities are only available if explicitly listed. When in doubt, ask first.
    No unauthorized visitors. The booking is for your vehicle only. Additional vehicles or people at the space require host approval.
    Report incidents immediately. Any damage, safety concerns, or problems — to your vehicle or the property — must be reported to Driveway Host support within 24 hours.

    This applies to both hosts and guests. No engine idling, no music audible outside the vehicle, no raised voices, no doors slamming. Neighborhoods trust Driveway Host because our community respects this rule. Violations can result in immediate booking cancellation without refund.

    The Window Placard

    Every Driveway Host booking generates a printable Window Placard in your confirmation email. It must be displayed in your windshield during any overnight stay.

    The placard serves three purposes: it identifies your vehicle as a verified, booked guest (protecting you from neighbor complaints and police check-ins), it communicates the booking rules to anyone who needs to know, and it helps hosts verify guests at a glance.

    What Happens When Standards Aren't Met

    Guest Violations
    Noise complaints, property damage, or overstaying may result in: immediate booking cancellation without refund, account suspension, and/or charges for cleaning or repairs assessed against the payment method on file.
    Host Violations
    Unsafe spaces, same-day cancellations, or misrepresented listings may result in: full guest refund, payout forfeiture for that booking, listing suspension, and account review for repeated issues.

    The Two Legal Issues You Need to Understand

    Most DUI laws target driving on public roads — but two doctrines can still reach you on private property.

    Most DUI/DWI statutes only apply to operation on a public road, highway, or street. A private residential driveway is not a public road — giving you meaningful protection in most states. Commercial lots (bars, stadiums) are often treated as public by courts, even if privately owned.

    Many states make it illegal to be in actual physical control of a vehicle while intoxicated — even without driving. Courts look at your seating position, key placement, and whether the engine is running. This doctrine can apply on private property in some states.

    The more of these that apply to you, the higher your risk — even on private property. Each one you eliminate helps your case.

    Highest Risk

    Courts treat the driver's seat as presumptive evidence you could operate the vehicle. Moving to the back seat is the single most impactful thing you can do.

    Highest Risk

    Even without the engine on, keys in the ignition signal intent to operate. Put them in your pocket, glove box, or trunk.

    Highest Risk

    Running the engine for heat or AC is universally treated as operating the vehicle. Also a genuine carbon monoxide risk in driveways. Don't do it.

    A secondary indicator that the vehicle was recently being operated. Turn all lights off before sleeping.

    😴 Awake vs. Asleep
    Context-Dependent

    Some courts view someone asleep in the back seat as unable to exert control. Being alert in the driver's seat is worse than being asleep in the back.

    Lower Risk if Parked

    Being properly parked entirely on private property reduces risk. Partially on a public road is bad. Fully on a booked private driveway is good.

    The Rules — In Every State

    Follow these regardless of your state's tier. They are the difference between a safe night and a very expensive morning.

    The Dos
    Sleep in the back seat. The single most important rule. Removes the primary APC factor in every state.
    Remove keys from ignition. Pocket, glove box, or trunk. Anywhere that isn't the ignition switch.
    Keep your booking confirmation accessible. A timestamped Driveway Host booking proves you are a lawful invited guest on private property.
    Park fully on the private property. No part of your vehicle in contact with a public road, sidewalk, or alley.
    Message your host. Let them know you'll be sleeping over. Most hosts are understanding — that's part of why private stays exist.
    Use blankets instead of the engine. Warm layers solve the temperature problem without the legal (and carbon monoxide) risk of running the engine.
    Tell someone where you are. Safety first — a friend or family member should know your location.
    The Don'ts
    Don't sit in the driver's seat. Officers treat this as presumptive evidence of control. Get in the back before you fall asleep.
    Don't leave keys in the ignition. Second most common basis for APC charges. Take them out before sleeping.
    Don't run the engine. Not for heat, AC, or phone charging. Legally and physically dangerous in an enclosed driveway.
    Don't move the vehicle at all while impaired. Even a few feet counts as "driving" under most statutes.
    Don't confuse a bar parking lot with a private driveway. Commercial lots are usually "open to public" by courts — far less protection than a booked residential driveway.
    Don't assume private property = full immunity. In FL, IA, MN, WI, and others, it isn't. Follow all rules regardless.
    Don't draw attention. Honking, flashing lights, engine starting and stopping — officers can't un-smell alcohol once they approach.

    Sleeping in your vehicle overnight requires a little planning beyond just the legal side. Here are your realistic restroom and hygiene options.

    The easiest option. Many Driveway Host hosts are happy to allow restroom access if asked in advance. Just message them before arrival — most say yes. Add it to your booking message when you let them know you're staying overnight.

    Purpose-made travel urination bags (like TravelJohn, Cleanwaste GO Anywhere, or Pibbs) are compact, odor-sealed, and turn liquid into a solid gel. Keep 2–3 in your glove box. They work for all genders, are available at Walmart/Amazon, and cost under $2 each. Dispose in any trash.

    If you're sober enough to safely walk (not drive), most cities have 24-hour options nearby: Walgreens/CVS, McDonald's, gas stations, hotel lobbies, or hospital emergency entrances. Search "open now near me" on your phone before you settle in for the night.

    Don't urinate in public, on the host's property without permission, or anywhere visible. This is a separate legal issue (public indecency / disorderly conduct) that carries its own fines. Portable bags solve this cleanly and privately.

    The Driveway Host Advantage

    A privately-booked residential driveway is the legally safest place to sleep in a vehicle when impaired. Here's why it's fundamentally different from any other option:

    Combine all of this with back-seat positioning, keys out of the ignition, and engine off — and you've done everything legally reasonable. The best plan is always a designated driver or rideshare. But when that's not an option, a booked private driveway is your best alternative.
